Given the conceptual gap in the global justice debate today (where most of the talk is about the duties of the rich, but little is said about what the poor may do for themselves), in this article I reintroduce the idea of a right of necessity. I first delineate a normative framework for such a right, inspired by these historical accounts. I then offer a contemporary case where the exercise of the right of necessity would be morally legitimate according to (...) that framework – even though illegal and probably condemned by the standard moral norms. The case is that of a small group of Paraguayan campesinos (small farmers) suffering from the effects of a severe drought. In the third part, I introduce the concept of noncivil disobedience: I call an act of noncivil disobedience a conscientious, public, illegal and forcible act whose performance, while not necessarily intended directly as a means to bring about social and/or political change, may help to trigger these changes indirectly. In the fourth part, I suggest that certain instances where the right of necessity is overtly exercised – as in the case of the famine-struck Paraguayan campesinos – may also be interpreted in terms of noncivil disobedience, insofar as they serve a double function: as a means of satisfying immediate need, and as a marker of discontent in a society where the equal rights of individuals are a nominal ideal which remains unfulfilled in practice. I then address two objections that may be raised against resurrecting the idea of a right of necessity and identifying it in certain instances with noncivil disobedience. I conclude by suggesting that, at the point of convergence between the two, a basic right like the right of necessity recovers its value as an active, (rather than passive) entitlement of its holders, while the use of force enters the picture as a legitimate means that – at least under certain circumstances – may be resorted to within the limits of civil society. By giving sympathy a central role, Adam Smith’s Theory of Moral Sentiments (1759) can be regarded as one of the ‘enlightened’ moral theories of the Enlightenment, insofar as it widened the scope of moral consideration beyond the traditionally restricted boundary of human beings. This, although the author himself does not seem to have been aware of this fact. In this paper, I want to focus on two aspects which I think lead to this conclusion. First, by making sentience the requisite (...) to be taken into moral consideration, nonhuman animals in Smith’s moral theory can count as moral patients towards whom we should exercise the virtue of beneficence (if not justice). Secondly, Smith’s idea of morality as working in concentric circles –generating more stringent duties towards those closer to us– could explain and perhaps also justify our caring for some nonhuman animals, especially pets. Narrowly understood, veganism is the practice of excluding all animal products from one’s diet, with the exception of human milk. More broadly, veganism is not only a food ethics, but it encompasses all other areas of life. As defined by the Vegan Society when it became an established charity in the UK in 1979, veganism is best understood as “a philosophy and way of living which seeks to exclude – as far as is possible and practicable – all forms of (...) exploitation of, and cruelty to, animals for food, clothing or any other purpose; and by extension, promotes the development and use of animal-free alternatives for the benefit of humans, animals and the environment”. There are two main moral justifications for veganism, both of which rely on a common assumption: that sentience, i.e., the capacity to feel pleasure and pain, is the necessary and sufficient trait to be morally considerable. In what follows, I present these two justifications and a third one which, although less popular, captures some core intuitions among vegans. I then present a challenge faced by veganism and two arguments that reject it as discriminatory, and briefly conclude. (shrink)

he territorial impacts of climate change will affect millions. This will happen not only as a direct consequence of climate change, but also because of policies for mitigating it—for example, through the installation of large wind and solar farms, the conservation of land in its role as carbon sink, and the extraction of materials needed for renewable energy technologies. In this article, we offer an overview of the justice-related issues that these impacts create. The literature on climate justice and territory (...) is vast and spans a range of disciplines, so we limit our discussion to a specific understanding of territory and a specific understanding of injustice that arises from its loss. We understand territory as a normative concept that describes a place under some agent's jurisdiction, where the agent is a politically organized collective and where the jurisdictional rights over that place secure a relevant degree of self-determination for that collective. Accordingly, we consider that the main injustice connected to the loss of territory due to climate change is the loss or undermining of the ability to exercise the collective right to self-determination, which requires some control over the place. This can happen if a territorial agent literally loses the ground where to stand as a direct effect of climate change, raising issues of justice in relocation; or if their place changes due to mitigation policies, affecting their use and understanding of territory, raising issues of justice in energy transition. From the end of the twelfth century until the middle of the eighteenth century, the concept of a right of necessity –i.e. the moral prerogative of an agent, given certain conditions, to use or take someone else’s property in order to get out of his plight– was common among moral and political philosophers, who took it to be a valid exception to the standard moral and legal rules. In this essay, I analyze Samuel Pufendorf’s account of such a right, founded (...) on the basic instinct of self-preservation and on the notion that, in civil society, we have certain minimal duties of humanity towards each other. I review Pufendorf’s secularized account of natural law, his conception of the civil state, and the function of private property. I then turn to his criticism of Grotius’s understanding of the right of necessity as a retreat to the pre-civil right of common use, and defend his account against some recent criticisms. Finally, I examine the conditions deemed necessary and jointly sufficient for this right to be claimable, and conclude by pointing to the main strengths of this account. El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. At the basis of modern natural law theories, the concept of the suum, or what belongs to the person (in Latin, his, her, its, their own), has received little scholarly attention despite its importance both in explaining and justifying not only the genealogy of property, but also that of morality and war.1 In this paper I examine Hugo Grotius's what it is, what things it includes, what rights it gives rise to and how it is extended in the transition from (...) the state of nature to civil society. I then briefly point out how bringing this concept back to the fore could help to illuminate the current discussion on the foundations of basic human rights, and to evaluate cases where these seem to clash with property rights. The purpose of this paper is to describe how judges engage in constitutional design, irrespective of legal tradition. I examine in great detail the role of the judge: as a conflict solver, as a member of an institution, as part of the political system and as a human being, for those are factors that intervene in the activities he makes. I later analyze the dynamics that a Constitution can have: the change in their structure conceptualized as interpretation, mutation and resistance (...) and their relation. Interpretation is the determination of the scope of a norm, mutation is the change of meaning without amendment and resistance is a concept that bridges the first two, which is the capacity of the constitutional rule to adapt to the political game and to assume mutations. Finally, these concepts are intertwined in order to show how judges by means of their function, (re)design the Constitution by means of adjudication and policymaking (rule issuance by the stating of precedent). La exterioridad de una cosa o de un estado de cosas configurados por el ser humano no implica para Hegel que esa cosa o ese estado de cosas deban ya por ello ser considerados como formas del espíritu objetivo, mientras que en contrapartida las formas del espíritu absoluto estarían entonces conformadas por contenidos ideales del pensamiento. La diferencia entre espíritu objetivo y espíritu absoluto no radica en la diferencia entre lo que el espíritu humano “hace” y lo que “conoce”. En (...) efecto, las obras de arte, es decir, configuraciones exteriores hechas por el ser humano utilizando, por ejemplo, piedras, metales, colores o sonidos, son para Hegel instancias del espíritu absoluto, mientras que, por su parte, realidades que en cuanto tales no son intuibles, como, por ejemplo, los contratos o la organización estatal, son instancias del espíritu objetivo. Que Hegel considere al arte como una forma del espíritu absoluto pone de manifiesto que, a sus ojos, las cosas que intuimos en el universo son, en rigor, productos del propio sujeto que las conoce. Espontáneamente el sujeto cognoscente piensa que lo que intuye es algo que recibe desde un mundo externo; sostener que el arte es una forma de conocimiento es justamente el modo como Hegel está expresando que lo intuido es en todos los casos un contenido producido por el propio espíritu, que es, por así decirlo, una obra de arte humano. En el arte mismo, sin embargo, la producción de la cosa intuible es insuficiente, dado que el material que el espíritu utiliza para sus configuraciones conserva en mayor o menor medida, según el caso, una determinidad propia que resiste a la determinidad que el espíritu busca conferirle. Por esta razón, las obras de arte se presentan inicialmente como productos arbitrarios. Recién cuando integra sus intuiciones en la actividad de comprensión -actividad cognitiva con la que opera la filosofía- y media con ello completamente la determinidad de los contenidos intuidos, el espíritu configura finalmente un universo que le es propio y específico. El objetivo de mi ponencia es reconstruir desde el marco teórico recién expuesto el sentido y función que Hegel le atribuye al arte en su teoría del conocimiento. (shrink)

Abstract: According to Hegel, comprehension proper is the ostensible self-determination of thinking with the determinations that spontaneously present themselves as independent objects. By positing objective determinations as the own determinations of thought, comprehension reveals thinking as an activity that is practical. For Hegel, comprehending allegedly extrinsic objects, and free willing of the own determinations of the thinking and willing subject, are in essence the same activity: only subjects who can choose between the determinations that determine them can comprehend objects. To (...) elucidate: only subjects who are able to actively determine themselves with the determinations that spontaneously determine them are able to analyse and comprehend the objects of their knowing activity. Free will skepticism is the view that people never truly deserve to be praised, blamed, or punished for what they do. One challenge free will skeptics face is to explain how criminality could be dealt with given their skepticism. This paper critically examines the prospects of implementing legal changes concerning crime and punishment derived from the free will skeptical views developed by Derk Pereboom and Gregg Caruso. One central aspect of the changes their views require is a concern for reducing (...) the severity of current forms of punishment. The paper considers two strategies for pursuing such a reduction. By taking into account evidence from the psychology of belief in free will and desire to punish, it is argued that a strategy aiming at a reduction of people’s natural desire to punish criminals can be successful if capable of providing alternatives to current forms of punishment satisfying three properties: they must be less harmful than current forms of punishment, more effective in preventing crime, and incompatible with current forms of punishment. People have disagreed on the significance of Libet-style experiments for discussions about free will. In what specifically concerns free will in a libertarian sense, some argue that Libet-style experiments pose a threat to its existence by providing support to the claim that decisions are determined by unconscious brain events. Others disagree by claiming that determinism, in a sense that conflicts with libertarian free will, cannot be established by sciences other than fundamental physics. This paper rejects both positions. First, it is (...) argued that neuroscience and psychology could in principle provide support for milder deterministic claims that would also conflict with libertarian free will. Second, it is argued that Libet-style experiments—due to some of their peculiar features, ones that need not be shared by neuroscience as a whole—currently do not support such less demanding deterministic claims. La actividad teórica y la actividad práctica han sido tradicionalmente entendidas como complementarias en el sentido que mediante la actividad teórica el sujeto se apropiaría idealmente de los objetos del mundo externo, mientras que mediante la actividad práctica realizaría sus propias metas subjetivas en el mundo. Sin embargo, dicho modelo plantea un conjunto de graves problemas exegéticos y conceptuales sobre la estructura y significado de la entera filosofía del espíritu de Hegel. En este artículo buscaremos esclarecer qué es a ojos (...) de Hegel lo propiamente específico de la actividad teórica y de la actividad práctica, para, sobre esa base, ofrecer un modelo exegético que logre dar satisfactoriamente cuenta de la particular periodización general que Hegel propone sobre las diferentes formas de actividad del espíritu humano. Multialgebras have been much studied in mathematics and in computer science. In 2016 Carnielli and Coniglio introduced a class of multialgebras called swap structures, as a semantic framework for dealing with several Logics of Formal Inconsistency that cannot be semantically characterized by a single finite matrix. In particular, these LFIs are not algebraizable by the standard tools of abstract algebraic logic. In this paper, the first steps towards a theory of non-deterministic algebraization of logics by swap structures are given. Specifically, (...) a formal study of swap structures for LFIs is developed, by adapting concepts of universal algebra to multialgebras in a suitable way. A decomposition theorem similar to Birkhoff’s representation theorem is obtained for each class of swap structures. Moreover, when applied to the 3-valued algebraizable logics J3 and Ciore, their classes of algebraic models are retrieved, and the swap structures semantics become twist structures semantics. This fact, together with the existence of a functor from the category of Boolean algebras to the category of swap structures for each LFI, suggests that swap structures can be seen as non-deterministic twist structures. This opens new avenues for dealing with non-algebraizable logics by the more general methodology of multialgebraic semantics. (shrink)

Ao analisar a teoria da memória mecânica de Hegel, a maioria dos intérpretes considerou apenas dois aspectos da memorização mecânica: o desaparecimento do significado nas palavras mecânicamente memorizadas ou a internalização totalmente abstrata da mente que as memoriza. No primeiro caso, a interpretação concentrou-se na relação entre o significante e o significado das palavras; no segundo caso, concentrou-se na relação entre o signo linguístico como um todo e a mente. Entretanto, a posição específica da memória mecânica na sistematização das atividades (...) cognitivas de Hegel não se baseia nessas duas relações, mas na relação entre o significado de cada palavra e o significado das outras palavras. Ao memorizar de cor fileiras de palavras que não estão conectadas umas às outras por seus significados, mas apenas pela força da mente que decide memorizá-las juntas, a mente se liberta de qualquer conteúdo dado externamente e sublima a referência linear do conteúdo representacional de cada significado à intuição em sua origem. A atualização do poder da mente de interconectar conteúdos de acordo com as próprias regras lógicas da mente realiza, para Hegel, a transição para o pensamento propriamente dito. (shrink)

Liberados el romanticismo y el idealismo del lastre secular de su vínculo imaginario con la “catástrofe alemana” deviene una vez más posible recurrir a ellos para repensar los problemas teóricos y prácticos del presente y localizar nuevos instrumentos conceptuales para su solución. En este contexto recobran interés numerosos temas que fueron objetos privilegiados de reflexión por parte de los pensadores románticos e idealistas. El romanticismo exaltó la Revolución Francesa como un acontecimiento epocal de reivindicación de los derechos de los individuos (...) contra la opresión de las formas anquilosadas de la religión y la organización estatal. Los pensadores románticos se rebelaron contra el orden burgués en todas sus formas, contra la pauta ubicua de la razón económico-instrumental. Para Kant, lo que es útil e intercambiable no posee dignidad, sino precio. El rechazo romántico de la exhaustiva reducción del mundo a mercancía conduce a la recuperación del valor infinito de la naturaleza, en esa medida, a su “reencantamiento”. En una misma línea, el romanticismo preconiza tendencialmente todos los fenómenos no cuantificables, aquéllos que no permiten ser calculados en términos mercantiles: la corporeidad, el erotismo, la pasión, la imaginación y la fantasía, el arte y la poesía, lo telúrico, la diversidad individual y cultural. El idealismo, por su parte, busca una síntesis entre la concepción ilustrada del mundo material y la visión pre-moderna del mismo. El resultado de esa mediación es la explicitación de las estructuras del propio espíritu humano presentes en su comprensión del mundo, toda vez que para el idealismo el mundo es siempre la teoría de la mente humana sobre el mundo. El pensamiento ilustrado pudo por ello confundir la filosofía de la naturaleza de los idealistas con una visión de lo material viciada de antropomorfismo, más próxima a la mística y a los bestiarios medievales que a las ciencias naturales de la Edad Moderna. El idealismo, por el contrario, encuentra en esta suerte de principio antrópico de toda teoría un factor de liberación moral y política. La toma de conciencia de que es el sujeto el que crea sistemas de sentido y que, por tanto, éstos deben reflejar en sí mismos su origen humano, implica el corolario de que con las teorías –sea cual sea el ámbito de la realidad que ellas busquen explicar– se trata en verdad de dispositivos de ordenamiento para el conocimiento y la acción construidas por la propia subjetividad humana; en esta medida, en su origen no se encuentran datos brutos de un supuesto orden natural que debe, por tanto, ser respetado sacralmente, sino la propia comunidad de sujetos vivientes. Aunque haya dejado tras de sí y olvidado el proceso de mediaciones que le dio origen, aunque se presente, pues, como replegado sobre sí mismo y, en esa medida, como la suma de re-presentaciones de un orden encontrado en el mundo, cada sistema de ideas contiene el conjunto de prácticas subjetivas inferenciales que lo constituyeron y que fueron realizadas por múltiples sujetos en plexos históricos concretos. El idealismo consiste en explicitar a la subjetividad actuando en el objeto y, con ello, en conminar el peligro de la mutación de las teorías en ideologías. El fundamento último de la libertad descansa para el idealismo menos en el orden determinado que funciona como condición de posibilidad del ejercicio de la libertad que en el modo de autoconcepción de la propia subjetividad. A partir del mundo de las autoconcepciones del sujeto –para Hegel se trata del ámbito específico del sujeto que ha devenido por ello mismo absoluto– derivan luego, como sus corolarios prácticos, las formas concretas de ordenamiento social y político. Si bien asume en sí numerosos motivos románticos, el idealismo aspira también a una mediación de esos elementos con las contribuciones teóricas de la Ilustración, con la que guarda entonces una relación menos crítica que el romanticismo. Fruto de este espíritu más ecuménico y menos orientado a la ruptura, defiende una concepción más pacífica de la racionalidad capitalista y el mundo burgués. Hegel reivindica así el rol positivo del mercado con su división social del trabajo y una concepción menos revolucionaria y más reformista de la vida política. El neoliberalismo contemporáneo se concibe a sí mismo como el sistema que resulta naturalmente del principio de la libertad negativa. Una tesis central del idealismo alemán es que para que sea posible el ejercicio de la capacidad de decidirse autónomamente por diferentes metas es necesario el marco efectivo de la libertad positiva. Sin la presencia de un orden racional con poder coercitivo sobre los miembros de la sociedad para regular su conducta, la libertad negativa de esos miembros, a primera vista disminuida y parcialmente cercenada por aquel orden, no es en la práctica posible. In my book *Resemblance Nominalism* I argued that the truthmakers of ´a and b resemble each other´ are just a and b. In his "Resemblance Nominalism and counterparts" Alexander Bird objects to my claim that the truthmakers of ´a and b resemble each other´ are just a and b. In this paper I respond to Bird´s objections.

Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. In the last few decades, the literature on moral responsibility has been increasingly populated by scientific studies. Studies in neuroscience and psychology, in particular, have been claimed to be relevant for discussions about moral responsibility in a number of ways. And at the same time, there is not yet a systematic understanding of the sort of questions a science of moral responsibility is supposed to answer. This paper is an attempt to move toward such an understanding. I discuss three models (...) for framing scientific questions relevant to an investigation of moral responsibility. The favored model—the Enhancement model—proposes that a science of moral responsibility has two descriptive tasks. First, science can describe the causes and effects of the many sorts of responses that constitute the human practices of moral responsibility, such as praise, blame, and punishment. And, second, science can describe how modifications aiming at the improvement of such practices can be achieved. Relatively to the other models to be considered, the Enhancement model is broader in scope and less tied to the traditional philosophical agenda on moral responsibility. (shrink)

In the process of knowledge imagination is, according to Hegel, the point where the human mind dissociates the object into two different contents - i.e. the thing of the external world and the internal content of the mind -, so that both versions of the object must corroborate each other in the way of a synthesis of heterogenous elements that only in their collation recognizes their identity. Comprehension sublates this dualism, and, by doing that, it sublates also the empiricist approach (...) to knowledge and the correspondence theory of truth which, for Hegel, are at its basis. Desde un esquema epistemológico sujeto-sujeto y desde un planteo feminista decolonial, nos acercará narrativas de mujeres mapuce que versan sobre la precarización de sus vidas y salud como parte de las violencias instituidas por la cultura hegemónica, poniendo sobre relieve la resiliencia de las culturas subalternizadas a partir de la lucha y re-existencia de estas mujeres.

Nuestro objetivo consiste en caracterizar la ontología corporal de las mujeres indígenas mapuce desde el esquema epistemológico sujeto-sujeto, propio de las teorías decoloniales. En este aspecto, nos interesa desnaturalizar ciertos mecanismos de subalternización, en tanto huellas de la colonialidad, que siguen operando no solo en la construcción de sentidos, sino también como reproductores de la opresión interseccional que experimentan estas mujeres. Preliminarmente, para este planteo, nos enfocaremos en la delimitación del concepto de interseccionalidad. Luego, intentaremos articular, desde un planteo feminista (...) decolonial, diversas narrativas de estas mujeres mapuce, vinculadas a la precarización de sus vidas y su salud, como parte de las violencias instituidas por la cultura hegemónica. Finalmente, nos resulta fundamental poner de relieve la resiliencia de las culturas subalternizadas, como forma horizontalizada de narrativizar un sentir decolonial desde la memoria performativa del cuerpo, contra ciertos dispositivos de subalternización, a partir de la clara referencia a las luchas y re-existencias de las mujeres indígenas mapuce, en el marco de una perspectiva situada en la decolonización, la emancipación y la liberación de los pueblos oprimidos. In a previous paper, I argued that neuroscience and psychology could in principle undermine libertarian free will by providing support for a subset of what I called “statements of local determination.” I also argued that Libet-style experiments have not so far supported statements of that sort. In a commentary to the paper, Adina Roskies and Eddy Nahmias accept the claim about Libet-style experiments, but reject the claim about the possibilities of neuroscience. In the Remark to the final paragraph of the Chapter on “existence” (Dasein) in the Logic of the Encyclopedia of the Philosophical Sciences in Basic Outline (1830) Hegel states that the “ideality of the finite is the chief proposition of philosophy” and that “every true philosophy is for that reason idealism” (Enz § 95A). In turn, at the end of the Chapter on “existence” in the Science of Logic (1832) Hegel claims, further, that “every philosophy is essentially idealism or at (...) least has idealism for its principle, and the question then is only how far this principle is carried out” (GW 21.142). Along this line, Hegel conceives of absolute idealism not only as the result of the history of philosophy, but also as the philosophical system that reveals the essence of the philosophical systems before idealism, that is to say, as the philosophy that reveals, by developing it and formulating it adequately, what the precedent philosophies, mostly unknowingly, tried to develop and formulate, namely a general theory about reality based on the principle of the unity of being and thought. According to Hegel, every particular philosophy throughout history exposed in a successive, partial and complementary way the process of identification of being and thought; inasmuch as the system of absolute idealism assumes the latently idealist theses present in former philosophies, it makes those theses explicit and exposes the process of the identification of being and thought as its own internal development. Thus, absolute idealism is for Hegel the philosophy that exposes and shows what philosophy is actually about. The purpose of this essay is to render explicit the metaphilosophical implications of Hegel´s conception of absolute idealism as the “true philosophy” (wahre Philosophie, wahrhafte Philosophie). Hegel´s social and political thought has been often been interpreted as a defense of authoritarian statism against modern individualism. In this paper I claim, on the contrary, that the value and dignity of the individual is the conclusion of Hegel´s philosophical anthropology and, thus, the principle and foundation of his entire political philosophy. The value and dignity of the individual rely, more precisely, on her freedom of selfdetermination. The different forms of personal interaction that Hegel develops in his philosophy of (...) Right are thus those that offer the condition of possibility for the exercise of the freedom of self-determination of each individual. Freedom as the capacity to determine oneself does not imply, however, that the goal of human action should be that each individual does whatever she wants. Common good is not the necessary result of the sum of all the actions of the individuals in order to obtain their private well-being; precisely because that is not the case, the common good must be a goal in itself and there must exist a specific organization that takes it as its own goal, namely the State. Indeed, the whole meaning of the State is for Hegel to guarantee that all individuals in society become effectively autonomous agents and can exert their capacity of selfdetermination. (shrink)

The logics of formal inconsistency (LFIs, for short) are paraconsistent logics (that is, logics containing contradictory but non-trivial theories) having a consistency connective which allows to recover the ex falso quodlibet principle in a controlled way. The aim of this paper is considering a novel semantical approach to first-order LFIs based on Tarskian structures defined over swap structures, a special class of multialgebras. The proposed semantical framework generalizes previous aproaches to quantified LFIs presented in the literature. The case of QmbC, (...) the simpler quantified LFI expanding classical logic, will be analyzed in detail. An axiomatic extension of QmbC called QLFI1o is also studied, which is equivalent to the quantified version of da Costa and D'Ottaviano 3-valued logic J3. The semantical structures for this logic turn out to be Tarkian structures based on twist structures. The expansion of QmbC and QLFI1o with a standard equality predicate is also considered. (shrink)

By treating America as a «new» continent «by virtue of its wholly peculiar character in both physical and political respects» Hegel reiterates the increasingly dominant image of America in the Europe of his time. This image crystallized in the context of the consolidation of the colonization process. According to Europeans, the inhabitants of the colonized lands were far less civilized than the inhabitants of Western Europe. Not a few thinkers found the explanation for that cultural difference in the natural differences (...) between the respective geographies, climates and races. In this general framework, Hegel considered the American Indians as people without history; as for the history of America after its conquest and colonization, it is in his eyes nothing other than an episode of the history of Europe itself. Insofar as it is through Europe´s history that human beings have attained self-consciousness of their essence, namely, freedom as autonomy and self-determination, Europe seems to be a non plus ultra of the ideological development of humanity. However, as seen from the perspective of the 21st century, the intellectual and political history of Europe can hardly be identified with the full awareness of the value and dignity of each human being as such. Since the countries of the American continent rely on the principle of civic nationalism and not on that of ethnic na-tionalism, which is typical for Europe, they signify, in this respect, a step forward with regard to the «principle of the European mind». Metaphysics relies on the presupposition of the non-being of the world: since the world has once not existed it is necessary to postulate a cause for its existence, i.e. an extrinsic principle to explain the absolute beginning of the causal series of all things that constitute the world. After the critique of theologizing metaphysics by authors like Kant, Hegel and Nietzsche, the notion of an absolute beginning still persists though in a field in which it often goes as such unnoticed, (...) while it factually enjoys wide acceptance, namely in epistemology. It sounds as a truism that knowledge begins: personal inexistence (birth-death cycle) and the phenomenon of unconsciousness (sleep-wake cycle) seem to endorse the obviousness of that statement. Now, to link the beginning of the phenomenal series of subjective acts of knowledge with the existence of an external world that causes the specific content of our temporary cognitive acts relies, however, on two presuppositions, namely on the thesis of a complete non-being or nothingness of knowledge and, intrinsically related to this first presupposition, on the thesis of an absolute beginning of cognitive activity. If knowledge begins from its own nothingness, there must be a cause that is external to the totality of acts of knowledge, a cause that it doesn´t belong to the series of cognitive acts and, therefore, that it is not caused by any of them: this uncaused cause of contentful knowledge is supposed to be the real world external to the knowing subject. In my paper I make explicit the relation between realist-empiricist approachs to epistemology and the double presupposition of the nothingness and absolute beginning of knowledge, I explain the difficulties implied by these two presuppositions and, finally, I propose as a plausible solution to those difficulties some key theoretical claims of absolute idealism. A história humana possui seus processos e especificidades no e do tempo e espaço, com certas rupturas e continuidades de certos processos e elementos. Podemos citar como exemplo: Os tipos e modos de desigualdades, sistemas escravistas e sistemas coloniais etc. Mas, não sendo igual ou da mesma forma. Há especificidades e características ligadas ao tempo e ao espaço contextual. Porém, sem dúvidas, há acontecimentos e fatos históricos que ocorrem com certas semelhanças e características entre passado e presente, ainda que dentro (...) dos seus respectivos contextos. Logo, a cada época e contexto social, político, econômico, cultural, religioso e histórico, podemos observar certas semelhanças, entre ‘o ontem e o hoje. ’ A exemplo, o Sistema Feudal que ocorreu em muitos continentes e países, e em tempos específicos e com suas especificidades contextuais. Desse modo, como já mencionado, parecem que certos elementos ou resquícios de fatos históricos anteriores ou passados se evidenciam em outras épocas e contextos. Não que sejam os mesmos sistemas, nem tampouco a continuidade deles, mas apenas semelhanças e características que parecem ‘ir e vir. ’ Diante de tais fatos, seus problemas e consequências; debruçamo-nos em fontes sobre o Sistema Feudal Europeu dos séc. X ao XIV d. C. para compreendermos elementos, eventos e episódios que vêm ocorrendo na contemporaneidade brasileira, com algumas semelhanças com o Sistema Feudal. Fundamentalmente, no que diz respeito às terras, grandes latifundiários, religião, política, economia e rituais. Assim, identificamos que: a) Religião, Política e ‘poder’, tanto no feudalismo quanto nas relações políticas atuais no Brasil, continuam na perspectiva de defender a propriedade privada de grandes extensões de terras nas mãos de poucos; b) manter e reproduzir as ideias conservadoras e ‘moralistas’ dos grupos que detém o ‘poder político e econômico’; e c) naturalizar a pobreza e a miséria da população como destino ou normal-natural, bem como atribuir às conquistas econômicas e materiais dos grandes latifundiários a algo divino ou determinado. The thesis that existence is radically different from the determinacy of an actually existing thing –Kant considers this thesis to be the unsurmountable objection against the cosmological and the ontological argument– is the same thesis that demands a specific explanation of the existence of that actually existing thing. The notion of existence that results from its complete exclusion from the realm of the contents thoroughgoing determined by real predicates requires, thus, precisely because this thoroughness excludes it, a specific reason that (...) explains that in the actually existing thing its own actual existence is in fact united with its own determinacy; that notion of existence, however, cancels at the same time the requirement of a sufficient reason of the existence of what actually exists, and again for the same reason, namely, because since existence is as such excluded from the determinacy of the existing things, it radically differs from the specific realm where determinacy is constituted (that is why existing things are thoroughgoing determined as possible), and, therefore, it invalidates any application to itself of the logical laws that are valid only for the merely possible domain of determinacy. Adorno asocia la concepción hegeliana del espíritu a la concepción en última instancia formal de la subjetividad de Kant y del Fichte de la Grundlage. La subjetividad no puede ser infinita: al sujeto siempre se le opone el objeto. Aunque pretende superar el subjetivismo de la concepción kantiana y fichteana del sujeto, la unidad del sujeto y el objeto que define al "espíritu" de Hegel es todavía un sujeto; fuera de este sujeto resiste siempre algo no-idéntico que le es irreductible; (...) un idealismo absoluto es como tal, pues, imposible. En una línea con esto, Adorno considera que la Lógica hegeliana carece de contenido y permanece, a pesar de sus pretensiones materiales, una teoría puramente formal. Ahora bien, Adorno no ofrece un análisis detallado de la argumentación de Hegel en contra de la concepción formal de la subjetividad que proponen Kant y el primer Fichte. Hegel diferencia la subjetividad vacía obtenida por abstracción a partir del sujeto empírico respecto de la subjetividad absoluta o espíritu. Adorno rastrea la esencia del idealismo absoluto en la relación entre sensibilidad e inteligibilidad; para Hegel, sin embargo, la clave del idealismo absoluto reside en la unidad entre ser y pensar, o, lo que para Hegel es en última instancia lo mismo, entre ser y determinidad. La teoría quizá más extensamente aceptada sobre la mente humana es la que la concibe como una tabula rasa o un “papel en blanco” que reproduce las cosas de un mundo externo. En esta concepción, la mente es identificada en la práctica con la esfera general de lo inteligible, mientras que el mundo real es asignado a la esfera de lo sensible. La actividad específica de la mente, esto es, el pensamiento, es considerada aquí como una actividad libre en el (...) sentido del libero arbitrio, es decir, como una actividad de suyo arbitraria que gira sin control en el vacío y obtiene su freno de la percepción sensible, en la precisa medida en que la percepción funciona en este paradigma como el punto de contacto entre la mente y el mundo. La percepción es vista así como el criterio que permite decidir cuándo la relación de la mente con el mundo es correcta y cuándo no lo es, es decir, cuándo los pensamientos son verdaderos y cuándo son falsos. No hay ninguna concepción sobre la mente humana que Hegel rechace más decididamente que la que acaba de ser descrita. (shrink)

From Gadamer's Habilitation thesis, “Plato’s dialectical ethics. Phenomenological Interpretations Relating to the Philebus” (1928), this article seeks to highlight the fundamental lines of Plato’s image, outlined in that author’s first philosophical publication (1931). The confrontation with the themes of ethics and dialectic, in the current state of Platonic studies, indicates that in Plato’s image drawn in the early confrontation with the Philebus, clearly influenced by the phenomenological notion of Dasein, one already finds the fundamental features of what will become Gadamer's (...) philosophical hermeneutics, fully emancipated from Heideggerian tutelage. En la exposición de la filosofía del espíritu subjetivo teórico, la filosofía del Espíritu Absoluto no parece a primera vista jugar ningún rol. Sin embargo, las formas del Espíritu Absoluto son en el Sistema de Hegel la explicitación de los contenidos implicados por las formas cognitivas de la inteligencia. En este sentido, la filosofía del Espíritu Absoluto es la realización de las formas del espíritu subjetivo teórico; en el contexto del Espíritu Absoluto, pues, Hegel presupone en forma directa la primera (...) forma general de su Psicología y, consecuentemente, la exposición precedente de la misma en el contexto de la filosofía del espíritu subjetivo. Pero a diferencia de su proceder en el caso de la Estética enciclopédica y las lecciones correspondientes así como en el de los capítulos de la Enciclopedia dedicados a la Filosofía y en las lecciones sobre la Historia de la Filosofía, en el caso de la Filosofía de la Religión –o, más precisamente, en el de las Lecciones sobre Filosofía de la Religión– Hegel expone nuevamente en forma cuasi-sistemática y en un grado considerable de extensión y detalle la entera filosofía del espíritu subjetivo teórico. A pesar de las numerosas modificaciones de estructura general y en parte de contenido de las diferentes lecciones sobre filosofía de la religión, en todas ellas Hegel mantiene la división de la misma en tres partes, a saber: "Concepto de religión", "Religión determinada" y "Religión consumada"; es en el contexto de la primera de estas partes, esto es, en la dedicada al Concepto de religión, donde Hegel retoma y desarrolla la teoría de las diferentes formas del espíritu subjetivo teórico. En este nuevo contexto, Hegel no se limita a recordar las tesis que había presentado en la Psicología propiamente dicha, sino que en algunos puntos precisa y complementa dichas tesis con valiosas observaciones y comentarios. En esta medida, a pesar de que han pasado inadvertidas en los estudios sobre la filosofía del espíritu subjetivo teórico de Hegel, las Lecciones sobre Filosofía de la Religión ofrecen una base textual ulterior para la reconstrucción de esa disciplina central del Sistema hegeliano. El presente trabajo tiene por objeto exponer la teoría de los actos teóricos del sujeto tal como Hegel la desarrolla en la lección sobre filosofía de la religión de 1827, toda vez que es en esta lección donde, en su etapa madura, Hegel ofrece los desarrollos más detallados y sistemáticos sobre el espíritu subjetivo teórico fuera del contexto específico de la filosofía del espíritu subjetivo. La doctrina del choque (Anstoß), que Fichte desarrolla ante todo en el Fundamento de toda la Doctrina de la Ciencia, pero también en otros escritos de la época de Jena, ha sido desde antaño objeto de crítica tanto por los admiradores como por los detractores de la filosofía fichteana. Existen al menos dos modos específicamente diferentes y aparentemente contrapuestos de comprender su sentido: según una lectura, el choque sería una autoafección del propio Yo; según otra, un residuo realista, en última (...) instancia incompatible con los compromisos idealistas del pensamiento de Fichte. La tensión entre ambos modos de comprender la tesis del choque pueden reeconcontrarse en la confrontación entre las interpretaciones así llamadas epistemológica y ontológica de la tesis de la “cosa en sí” en la filosofía de Kant –tesis con la que de hecho suele asociarse la tesis fichteana del choque. En este contexto, Hegel parecería a primera vista presentarse –por ejemplo, si se considera el escrito de la Diferencia entre los sistemas de filosofía de Fichte y Schelling– como partidario de una interpretación robusta, ontológica, de la tesis del choque; sin embargo, si se analiza el corpus hegeliano en su conjunto la posición de Hegel resulta ser más matizada y próxima a una interpretación por así llamarla epistemológica de dicha tesis. Con todo, aun así la postura de Hegel sobre el sentido de la tesis fichteana del choque en el contexto de una filosofía idealista continúa siendo crítica. (shrink)

In 1988, J. Ivlev proposed some (non-normal) modal systems which are semantically characterized by four-valued non-deterministic matrices in the sense of A. Avron and I. Lev. Swap structures are multialgebras (a.k.a. hyperalgebras) of a special kind, which were introduced in 2016 by W. Carnielli and M. Coniglio in order to give a non-deterministic semantical account for several paraconsistent logics known as logics of formal inconsistency, which are not algebraizable by means of the standard techniques. Each swap structure induces naturally a (...) non-deterministic matrix. The aim of this paper is to obtain a swap structures semantics for some Ivlev-like modal systems proposed in 2015 by M. Coniglio, L. Fariñas del Cerro and N. Peron. Completeness results will be stated by means of the notion of Lindenbaum–Tarski swap structures, which constitute a natural generalization to multialgebras of the concept of Lindenbaum–Tarski algebras. El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. Tomás de Aquino diferencia como dos principios metafísicos diferentes la suma de de-terminaciones que especifican como tal a un ente y el hecho de que dicho ente efecti-vamente exista en la realidad. Ahora bien, al definirse como lo otro de la esencia el ser tiende a devenir él mismo una especie de esencia que requiere, al igual que la esencia propiamente dicha, ser puesto a su vez en la existencia. Este corolario fue derivado de la tesis de la distinción real (...) ya en tiempos del propio Tomás por pensadores como Egidio Romano y recogido luego a lo largo de la Edad Media hasta los tiempos de Francisco Suárez. El neotomismo del siglo XX intentó eludir ese corolario echando mano del ar-gumento de la causalidad recíproca entre el ser y la esencia: el ser pondría a la esencia en la existencia y con el ser así recibido la esencia limitaría correlativamente al ser. No obstante, la distinción real del ser y la esencia parecería no poder evitar que el ser se convierta como tal en un ente sui generis que consecuentemente reproduce en su propio interior la estructura doble de esencia y ser. El presente trabajo tiene por objeto analizar en detalle las dificultades que plantea la tesis de la causalidad recíproca para fundamen-tar la tesis de la limitación del ser por la esencia. (shrink)

Diana Pérez (2005) criticizes Davidson’s argument for the thesis that there is no thought without language, and offers an alternative defense of that thesis on the basis of empirical studies on developmental psychology. In this comment I argue that more recent studies do not seem to affect Davidson’s argument in the way Pérez suggests, and that her alternative defense of the thesis that there is no thought without language is insufficient. At the end, I offer a sketch of how a (...) weaker and more tenable version of the argument could be articulated. (shrink)

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' This paper focuses on Gilberto Gomes’ work on free will. In a series of contributions that have had a significant impact on the respective literature, Gomes developed a conception about free will and argued that its existence is consistent with recent scientific findings, specially in neuroscience. In this paper, I object to a claim of Gomes about his conception of free will, namely the claim that it is a compatibilist conception. I seek to show that Gomes does not use the (...) term ‘compatibilism’ as it is usual in the contemporary literature on free will, i.e., as the thesis that free will can exist even if determinism is true. Moreover, the conception of free will Gomes proposes actually has an incompatibilist commitment. I argue that, more than a mere terminological point, acknowledging the incompatibilist aspect of Gomes’ view motivates important questions about the details of the view and helps to reveal a limitation of his defense of the existence of free will. [Este artigo tem como tema o trabalho de Gilberto Gomes sobre o livre-arbítrio. Em uma série de contribuições que tiveram um impacto significativo na respectiva literatura, Gomes elaborou uma concepção sobre o livre-arbítrio e argumentou que sua existência é consistente com descobertas científicas recentes, especialmente na neurociência. Neste artigo, questiono uma afirmação de Gomes sobre sua concepção sobre o livre-arbítrio, a saber, que se trata de uma concepção compatibilista. Busco mostrar que Gomes não usa o termo ‘compatibilismo’ como é habitual na literatura contemporânea sobre o livre-arbítrio, isto é, como a tese segundo a qual o livre-arbítrio pode existir ainda que o determinismo seja verdadeiro. Ademais, a concepção sobre o livre-arbítrio desenvolvida por Gomes tem, efetivamente, um compromisso incompatibilista. Argumento que, mais do que uma mera elucidação terminológica, reconhecer o elemento incompatibilista presente na proposta de Gomes suscita questões importantes sobre os detalhes da proposta e também ajuda a reconhecer uma limitação de sua defesa da existência do livre-arbítrio.]. Para Hegel, Asia señala el comienzo de la historia universal, mientras que Europa señala su consumación y final. La América precolombina, al igual que la África negra, están para Hegel fuera de la historia universal; en cuanto a la historia de América tras su descubrimiento por los europeos, Hegel sostiene que lo que ha sucedido desde entonces en el continente americano proviene, en rigor, del “principio de Europa”. Hegel contrapone a su vez la historia de América Latina a la de (...) los actuales Estados Unidos en términos del respectivo desarrollo económico y social. Hegel atribuye la brecha de desarrollo entre las dos Américas, por un lado, a que América Latina es católica y Estados Unidos es mayoritariamente protestante, y, por el otro, a que América Latina fue “conquistada”, mientras que Estados Unidos fue “colonizado”. Sobre la base del análisis de los textos pertinentes de la obra de Hegel, se reconstruirá su teoría sobre el desigual nivel de desarrollo socio-económico de América Latina y Estados Unidos y se evaluará la plausibilidad, actualidad y eventual deficiencia de la misma. According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state and co-citizens. (...) In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. Although the controversy between Malthus and Ricardo has long been considered to be an important source for the history of economic thought, it has hardly been the object of a careful study qua controversy, i.e. as a polemical dialogical exchange. We have undertaken to fill this gap, within the framework of a more ambitious project that places controversies at the center of an account of the history of ideas, in science and elsewhere. It is our contention that the dialogical co-text (...) is essential for reconstructing the meaning and the evolution of science. In the present paper we try to substantiate this contention by means of a pragma-rhetorical study of this particular controversy. First, we reconstruct, through an analysis of a chunk of the correspondence, a micro-level of specific moves and countermoves which constitute a sequential structure within which also meta-scientific and meta-controversial considerations play a role. We then move to a macro-level of analysis, looking for recurrent patterns of argumentation. Finally, we draw epistemological conclusions on the nature of rationality and progress as manifested in actual scientific controversies. (shrink)
