Narrowly understood, veganism is the practice of excluding all animal products from one’s diet, with the exception of human milk. More broadly, veganism is not only a food ethics, but it encompasses all other areas of life. As defined by the Vegan Society when it became an established charity in the UK in 1979, veganism is best understood as “a philosophy and way of living which seeks to exclude – as far as is possible and practicable – all forms of (...) exploitation of, and cruelty to, animals for food, clothing or any other purpose; and by extension, promotes the development and use of animal-free alternatives for the benefit of humans, animals and the environment”. There are two main moral justifications for veganism, both of which rely on a common assumption: that sentience, i.e., the capacity to feel pleasure and pain, is the necessary and sufficient trait to be morally considerable. In what follows, I present these two justifications and a third one which, although less popular, captures some core intuitions among vegans. I then present a challenge faced by veganism and two arguments that reject it as discriminatory, and briefly conclude. (shrink)

Given the conceptual gap in the global justice debate today (where most of the talk is about the duties of the rich, but little is said about what the poor may do for themselves), in this article I reintroduce the idea of a right of necessity. I first delineate a normative framework for such a right, inspired by these historical accounts. I then offer a contemporary case where the exercise of the right of necessity would be morally legitimate according to (...) that framework – even though illegal and probably condemned by the standard moral norms. The case is that of a small group of Paraguayan campesinos (small farmers) suffering from the effects of a severe drought. In the third part, I introduce the concept of noncivil disobedience: I call an act of noncivil disobedience a conscientious, public, illegal and forcible act whose performance, while not necessarily intended directly as a means to bring about social and/or political change, may help to trigger these changes indirectly. In the fourth part, I suggest that certain instances where the right of necessity is overtly exercised – as in the case of the famine-struck Paraguayan campesinos – may also be interpreted in terms of noncivil disobedience, insofar as they serve a double function: as a means of satisfying immediate need, and as a marker of discontent in a society where the equal rights of individuals are a nominal ideal which remains unfulfilled in practice. I then address two objections that may be raised against resurrecting the idea of a right of necessity and identifying it in certain instances with noncivil disobedience. I conclude by suggesting that, at the point of convergence between the two, a basic right like the right of necessity recovers its value as an active, (rather than passive) entitlement of its holders, while the use of force enters the picture as a legitimate means that – at least under certain circumstances – may be resorted to within the limits of civil society. he territorial impacts of climate change will affect millions. This will happen not only as a direct consequence of climate change, but also because of policies for mitigating it—for example, through the installation of large wind and solar farms, the conservation of land in its role as carbon sink, and the extraction of materials needed for renewable energy technologies. In this article, we offer an overview of the justice-related issues that these impacts create. The literature on climate justice and territory (...) is vast and spans a range of disciplines, so we limit our discussion to a specific understanding of territory and a specific understanding of injustice that arises from its loss. We understand territory as a normative concept that describes a place under some agent's jurisdiction, where the agent is a politically organized collective and where the jurisdictional rights over that place secure a relevant degree of self-determination for that collective. Accordingly, we consider that the main injustice connected to the loss of territory due to climate change is the loss or undermining of the ability to exercise the collective right to self-determination, which requires some control over the place. This can happen if a territorial agent literally loses the ground where to stand as a direct effect of climate change, raising issues of justice in relocation; or if their place changes due to mitigation policies, affecting their use and understanding of territory, raising issues of justice in energy transition. From the end of the twelfth century until the middle of the eighteenth century, the concept of a right of necessity –i.e. the moral prerogative of an agent, given certain conditions, to use or take someone else’s property in order to get out of his plight– was common among moral and political philosophers, who took it to be a valid exception to the standard moral and legal rules. In this essay, I analyze Samuel Pufendorf’s account of such a right, founded (...) on the basic instinct of self-preservation and on the notion that, in civil society, we have certain minimal duties of humanity towards each other. I review Pufendorf’s secularized account of natural law, his conception of the civil state, and the function of private property. I then turn to his criticism of Grotius’s understanding of the right of necessity as a retreat to the pre-civil right of common use, and defend his account against some recent criticisms. Finally, I examine the conditions deemed necessary and jointly sufficient for this right to be claimable, and conclude by pointing to the main strengths of this account. People have disagreed on the significance of Libet-style experiments for discussions about free will. In what specifically concerns free will in a libertarian sense, some argue that Libet-style experiments pose a threat to its existence by providing support to the claim that decisions are determined by unconscious brain events. Others disagree by claiming that determinism, in a sense that conflicts with libertarian free will, cannot be established by sciences other than fundamental physics. This paper rejects both positions. First, it is (...) argued that neuroscience and psychology could in principle provide support for milder deterministic claims that would also conflict with libertarian free will. Second, it is argued that Libet-style experiments—due to some of their peculiar features, ones that need not be shared by neuroscience as a whole—currently do not support such less demanding deterministic claims. By giving sympathy a central role, Adam Smith’s Theory of Moral Sentiments (1759) can be regarded as one of the ‘enlightened’ moral theories of the Enlightenment, insofar as it widened the scope of moral consideration beyond the traditionally restricted boundary of human beings. This, although the author himself does not seem to have been aware of this fact. In this paper, I want to focus on two aspects which I think lead to this conclusion. First, by making sentience the requisite (...) to be taken into moral consideration, nonhuman animals in Smith’s moral theory can count as moral patients towards whom we should exercise the virtue of beneficence (if not justice). Secondly, Smith’s idea of morality as working in concentric circles –generating more stringent duties towards those closer to us– could explain and perhaps also justify our caring for some nonhuman animals, especially pets. At the basis of modern natural law theories, the concept of the suum, or what belongs to the person (in Latin, his, her, its, their own), has received little scholarly attention despite its importance both in explaining and justifying not only the genealogy of property, but also that of morality and war.1 In this paper I examine Hugo Grotius's what it is, what things it includes, what rights it gives rise to and how it is extended in the transition from (...) the state of nature to civil society. I then briefly point out how bringing this concept back to the fore could help to illuminate the current discussion on the foundations of basic human rights, and to evaluate cases where these seem to clash with property rights. Free will skepticism is the view that people never truly deserve to be praised, blamed, or punished for what they do. One challenge free will skeptics face is to explain how criminality could be dealt with given their skepticism. This paper critically examines the prospects of implementing legal changes concerning crime and punishment derived from the free will skeptical views developed by Derk Pereboom and Gregg Caruso. One central aspect of the changes their views require is a concern for reducing (...) the severity of current forms of punishment. The paper considers two strategies for pursuing such a reduction. By taking into account evidence from the psychology of belief in free will and desire to punish, it is argued that a strategy aiming at a reduction of people’s natural desire to punish criminals can be successful if capable of providing alternatives to current forms of punishment satisfying three properties: they must be less harmful than current forms of punishment, more effective in preventing crime, and incompatible with current forms of punishment. Abstract: According to Hegel, comprehension proper is the ostensible self-determination of thinking with the determinations that spontaneously present themselves as independent objects. By positing objective determinations as the own determinations of thought, comprehension reveals thinking as an activity that is practical. For Hegel, comprehending allegedly extrinsic objects, and free willing of the own determinations of the thinking and willing subject, are in essence the same activity: only subjects who can choose between the determinations that determine them can comprehend objects. To (...) elucidate: only subjects who are able to actively determine themselves with the determinations that spontaneously determine them are able to analyse and comprehend the objects of their knowing activity. In this chapter I shall reply to a pair of articles in which the main contention of my “Why truthmakers” – namely, that an important class of synthetic true propositions have entities as truth-makers – is rejected. In §§1–5 I reply to Jennifer Hornsby’s “Truth without Truthmaking Entities” (2005) and in §§6–7 I reply to Julian Dodd’s “Negative Truths and Truthmaker Principles” (2007).

Time and space are conflated in time-warps when asleep we dream. Our wakeful cognitive ability to keep them separate indicates different ways of envisaging self-hood. Awareness that dream-time and life-time are separate is itself a propensity of human minds that has evolved by natural selection with adaptive developments in cerebral neuronal circuitry that underpin human behavioural complexity. The contrast is highlighted between how memory of our spatio-temporal experiences appears to be treated by our brain one way when we are wide-awake (...) and thus well aware of our unfolding personal life-history, and in a different way when, fast asleep, our dreaming dissolves any such awareness and our oneiric self-hood seems different from our real-life self-hood. The difference is considered from two angles. Regarding simultaneous memory-storage for an experience recalled from alternative perspectives, a theoretical possibility is proposed of a pro-system comparable to Cantor Ternary Set topology. Regarding the brain, the difference is considered in relation to the temporo-spatial theory of consciousness and the compatible concept of active inference forestalling surprisal by minimising variational free energy according to the free energy principle. Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. Hegel ofrece dos formas -en su filosofía en último análisis complementarias- de caracterizar al idealismo: La primera es próxima a la concepción habitual de idealismo previa a Kant, a saber: como una posición que considera que aquello que conocemos es una modificación de la propia conciencia. La segunda descansa en la tesis de la nulidad de lo finito; según esto, ?idealista? es la filosofía que considera que lo finito no tiene en cuanto tal realidad; ?realista?, a la inversa, es la (...) filosofía que toma el ser de las cosas determinadas como algo fijo y definitivo. Hegel denomina a este idealismo ?absoluto?.El idealismo absoluto es el modelo teórico que interrelaciona la tesis del carácter intrínsecamente ideal de los objetos de conocimiento y la tesis de que las cosas singulares que constituyen el mundo real surgen como una autodeterminación del ser. La premisa que permite tal vínculo es la tesis defendida por Hegel de que ser y pensar nunca se han separado y que su separación es el resultado de una concepción posterior errónea de la mente humana sobre la naturaleza de su actividad cognitiva. La hipostasiación de la disociación que la forma cognitiva de la representación introduce en la unidad indiferenciada de ser y pensar de la que parte la actividad de conocimiento en el sentimiento y la intuición sensibles es para Hegel la que provoca la ilusión retroactiva de que ambos -ser y pensar, mundo conocido y mente que conoce- se diferencian y contraponen. Por el contrario, desde el momento que la sensación es también ella misma un modo particular de la actividad continua e ininterrumpida del pensamiento, en el itinerario que va de la percepción sensible a la comprensión del objeto no hay para Hegel un punto en donde pueda introducirse una fractura que disuelva la unidad primigenia entre el ser y el pensar. En esta precisa medida, el momento final de la actividad de conocimiento, es decir, la actividad de comprender el mundo, es a un tiempo la singularización de los contenidos universales que constituyen la teoría del sujeto sobre el mundo y la autodeterminación de la unidad ser-pensar de la que parte y en todo momento permanece el sujeto que elabora esa teoría. Arribados al punto de vista del concepto, la dicotomía realismo-idealismo queda develada como un corolario de la autoconcepción representacionalista de la subjetividad cognoscente. Esta concepción define al paradigma general del realismo, el cual incluye para Hegel como el anverso y reverso de un mismo modelo teórico tanto lo que tradicionalmente ha sido entendido como realismo como al idealismo que resulta de una universalización de la idealidad de la conciencia singular, ya sea en la variante propuesta por Berkeley, ya sea en la del idealismo trascendental de Kant. A ojos de Hegel, por el contrario, el idealismo no puede ser sino absoluto, es decir, debe incluir en sí mismo el momento del ser y, con él, la realidad de las cosas que el sujeto conoce: la tarea esencial de la filosofía no consiste para Hegel más que en tomar conciencia de la co-pertenencia y unidad intrínseca de ambos. La presente investigación tiene como propósito general asumir un posicionamiento filosófico en clave histórico-social y de tipo anti-relativista para analizar el desarrollo histórico de la matemática, el cual aplicaremos a un caso en particular: la matemática del antiguo Egipto. Para ello se discutirán y criticarán, en primera instancia, determinadas posiciones filosóficas afines al cuasi-empirismo en matemática que, siendo relativistas, permitirán delinear nuestro propio posicionamiento en contraste: la existencia de una «matemática situada». Esta categoría filosófica tendrá como sustento teórico la noción (...) de conocimiento situado. Además, las implicaciones de esta son, según sostenemos, tanto filosóficas como historiográficas, ya que servirá para analizar las características del corpus de problemas matemáticos egipcios registrados en los diversos papiros matemáticos. En particular, haremos referencia a las expresiones lingüísticas egipcias para denotar las diversas operaciones aritméticas y el carácter algorítmico de los problemas, así como también la cuestión epistemológica de la empiria y cómo la perspectiva situada permite superar la dicotomía entre una matemática pura y otra aplicada, que consideramos no es ubicua para abordar la interpretación de la práctica matemática del antiguo país del Nilo. In the current debate in political philosophy, the so-called communitarian thinkers intend to offer an alternative to the dominant liberal thought. The ideal of ethicalcommunity as way of life in society in which intersubjective relationships are ruled by laws conceived as public laws, reintroduces the question of virtue in the scope of social and political life, with the requirement of an ethical style of doing politics.

Adorno asocia la concepción hegeliana del espíritu a la concepción en última instancia formal de la subjetividad de Kant y del Fichte de la Grundlage. La subjetividad no puede ser infinita: al sujeto siempre se le opone el objeto. Aunque pretende superar el subjetivismo de la concepción kantiana y fichteana del sujeto, la unidad del sujeto y el objeto que define al "espíritu" de Hegel es todavía un sujeto; fuera de este sujeto resiste siempre algo no-idéntico que le es irreductible; (...) un idealismo absoluto es como tal, pues, imposible. En una línea con esto, Adorno considera que la Lógica hegeliana carece de contenido y permanece, a pesar de sus pretensiones materiales, una teoría puramente formal. Ahora bien, Adorno no ofrece un análisis detallado de la argumentación de Hegel en contra de la concepción formal de la subjetividad que proponen Kant y el primer Fichte. Hegel diferencia la subjetividad vacía obtenida por abstracción a partir del sujeto empírico respecto de la subjetividad absoluta o espíritu. Adorno rastrea la esencia del idealismo absoluto en la relación entre sensibilidad e inteligibilidad; para Hegel, sin embargo, la clave del idealismo absoluto reside en la unidad entre ser y pensar, o, lo que para Hegel es en última instancia lo mismo, entre ser y determinidad. En la exposición de la filosofía del espíritu subjetivo teórico, la filosofía del Espíritu Absoluto no parece a primera vista jugar ningún rol. Sin embargo, las formas del Espíritu Absoluto son en el Sistema de Hegel la explicitación de los contenidos implicados por las formas cognitivas de la inteligencia. En este sentido, la filosofía del Espíritu Absoluto es la realización de las formas del espíritu subjetivo teórico; en el contexto del Espíritu Absoluto, pues, Hegel presupone en forma directa la primera (...) forma general de su Psicología y, consecuentemente, la exposición precedente de la misma en el contexto de la filosofía del espíritu subjetivo. Pero a diferencia de su proceder en el caso de la Estética enciclopédica y las lecciones correspondientes así como en el de los capítulos de la Enciclopedia dedicados a la Filosofía y en las lecciones sobre la Historia de la Filosofía, en el caso de la Filosofía de la Religión –o, más precisamente, en el de las Lecciones sobre Filosofía de la Religión– Hegel expone nuevamente en forma cuasi-sistemática y en un grado considerable de extensión y detalle la entera filosofía del espíritu subjetivo teórico. A pesar de las numerosas modificaciones de estructura general y en parte de contenido de las diferentes lecciones sobre filosofía de la religión, en todas ellas Hegel mantiene la división de la misma en tres partes, a saber: "Concepto de religión", "Religión determinada" y "Religión consumada"; es en el contexto de la primera de estas partes, esto es, en la dedicada al Concepto de religión, donde Hegel retoma y desarrolla la teoría de las diferentes formas del espíritu subjetivo teórico. En este nuevo contexto, Hegel no se limita a recordar las tesis que había presentado en la Psicología propiamente dicha, sino que en algunos puntos precisa y complementa dichas tesis con valiosas observaciones y comentarios. En esta medida, a pesar de que han pasado inadvertidas en los estudios sobre la filosofía del espíritu subjetivo teórico de Hegel, las Lecciones sobre Filosofía de la Religión ofrecen una base textual ulterior para la reconstrucción de esa disciplina central del Sistema hegeliano. El presente trabajo tiene por objeto exponer la teoría de los actos teóricos del sujeto tal como Hegel la desarrolla en la lección sobre filosofía de la religión de 1827, toda vez que es en esta lección donde, en su etapa madura, Hegel ofrece los desarrollos más detallados y sistemáticos sobre el espíritu subjetivo teórico fuera del contexto específico de la filosofía del espíritu subjetivo. Este artigo reconstrói os argumentos de Donald Davidson (1970) em favor de sua teoria do monismo anômalo e revisa as principais críticas que recebeu. Essa teoria é amplamente rejeitada atualmente e, dadas as inúmeras críticas recebidas, é razoável concluir que qualquer tentativa de reabilitação tem um longo caminho pela frente. A diversidade dessas críticas sugere que não há consenso sobre por que exatamente o monismo anômalo fracassa, embora as dificuldades pareçam convergir sobre a justificação e possibilidade da tese monista, e (...) não sobre a anomalia do mental. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' From Gadamer's Habilitation thesis, “Plato’s dialectical ethics. Phenomenological Interpretations Relating to the Philebus” (1928), this article seeks to highlight the fundamental lines of Plato’s image, outlined in that author’s first philosophical publication (1931). The confrontation with the themes of ethics and dialectic, in the current state of Platonic studies, indicates that in Plato’s image drawn in the early confrontation with the Philebus, clearly influenced by the phenomenological notion of Dasein, one already finds the fundamental features of what will become Gadamer's (...) philosophical hermeneutics, fully emancipated from Heideggerian tutelage. Son aquí objeto de estudio las diferentes vías de comunicación entabladas por Leibniz con la tradición, con su época o con la filosofía posterior. Im gesprochenen und geschriebenen Sprachzeichen kehrt der Geist zur Anschauung eines äußeren Objektes zurück, dessen Bestimmtheit aber die Vorstellung der Bedeutung des Sprachzeichens ist bzw. sein soll. Als Gedächtnis wiederholt dann der Geist den Subjektivierungs- und Idealisierungsprozeß - den Prozeß des Vorstellens - an dieser besonderen Art Anschauung. Nun, wenn das Subjekt ein Wort hört oder liest, das es noch nicht assimiliert hat, versteht es nicht, was es bedeutet; in dem Fall ist die Verknüpfung des Gehörten oder Gelesenen mit seiner (...) Bedeutung im Sprachzeichen dem Subjekt so äußerlich wie das gehörte oder gelesene Wort selbst. Wenn der Geist sich zum Stadium der Sprache erhoben hat, zeigt sich somit der abstrakte Charakter seiner vorstellenden Tätigkeit weiter im verbleibenden Unterschied der Bedeutungen der Wörter zu den sie ausdrückenden Anschauungen. Das Gedächtnis soll eben diesen Unterschied aufheben - nicht den bereits aufgehobenen Unterschied des angeschauten äußeren Objekts zur Subjektivität. Im Gegensatz zu dem, was auf der Ebene des Vorstellens der anfänglichen Anschauungen geschieht, ist also nicht die Subjektivierung der Objektivität der Kern, um den sich nunmehr der theoretische Prozeß dreht, sondern das Verhältnis der an sich idealisierten Objektivität der Wortzeichen zu deren Bedeutung. Hegels Einordnung dieses neuen Idealisierungsprozesses bzw. des Gedächtnisses in das System des theoretischen Geistes erweist sich aber als höchst problematisch. In unserem Vortrag werden wir die diesbezüglichen Probleme darstellen und erörtern. (shrink)

Kant explicitou, talvez com maior clareza que qualquer outro filósofo antes do que ele, a essência do conflito que implica a relação da causalidade natural e a causalidade livre. Hegel assevera que com o dualismo fenômeno-coisa em si Kant deixa intacta como tal a incompatibilidade entre as noções de causalidade natural e causalidade livre, já que, conserva sua contraposição mesma para simplesmente localizá-la na estrutura do sujeito. Hegel aspira precisamente a fechar o ciclo da metafísica dualista que definiu a filosofia (...) dos seus começos e, com isso, a dar solução definitiva às dificuldades que lhe são inerentes; para esse fim exige o abandono do paradigma que a constituiu como tal e propõe no seu lugar uma autêntica revolução no campo da ontologia e a teoria do conhecimento. Neste contexto geral, Hegel oferece uma solução inovadora ao problema da incompatibilidade entre causalidade natural e causalidade livre, entre determinismo e liberdade. (shrink)

La América precolombina, al igual que la África negra, están para Hegel fuera de la historia universal; en cuanto a la historia de América tras su descubrimiento por los europeos, Hegel sostiene que lo que ha sucedido desde entonces en el continente americano proviene, en rigor, del “principio de Europa”. Hegel contrapone a su vez la historia de América Latina a la de (...) los actuales Estados Unidos en términos del respectivo desarrollo económico y social. Hegel atribuye la brecha de desarrollo entre las dos Américas, por un lado, a que América Latina es católica y Estados Unidos es mayoritariamente protestante, y, por el otro, a que América Latina fue “conquistada”, mientras que Estados Unidos fue “colonizado”. Sobre la base del análisis de los textos pertinentes de la obra de Hegel, se reconstruirá su teoría sobre el desigual nivel de desarrollo socio-económico de América Latina y Estados Unidos y se evaluará la plausibilidad, actualidad y eventual deficiencia de la misma. Multialgebras have been much studied in mathematics and in computer science. In 2016 Carnielli and Coniglio introduced a class of multialgebras called swap structures, as a semantic framework for dealing with several Logics of Formal Inconsistency that cannot be semantically characterized by a single finite matrix. In particular, these LFIs are not algebraizable by the standard tools of abstract algebraic logic. In this paper, the first steps towards a theory of non-deterministic algebraization of logics by swap structures are given. Specifically, (...) a formal study of swap structures for LFIs is developed, by adapting concepts of universal algebra to multialgebras in a suitable way. A decomposition theorem similar to Birkhoff’s representation theorem is obtained for each class of swap structures. Moreover, when applied to the 3-valued algebraizable logics J3 and Ciore, their classes of algebraic models are retrieved, and the swap structures semantics become twist structures semantics. This fact, together with the existence of a functor from the category of Boolean algebras to the category of swap structures for each LFI, suggests that swap structures can be seen as non-deterministic twist structures. This opens new avenues for dealing with non-algebraizable logics by the more general methodology of multialgebraic semantics. (shrink)

Aristotle recognizes a series of difficulties when it comes to understanding the starting points of a scientific or philosophical system, and contemporary scholars have encountered their own difficulties in understanding his response. I will argue that Aristotle was aware of a Platonic solution that can help us uncover his own attitude toward the problem.Aristotle's central problem with first principles arises from the (...) fact that they cannot be demonstrated in the same way as other propositions. According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state and co-citizens. In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. In a previous paper, I argued that neuroscience and psychology could in principle undermine libertarian free will by providing support for a subset of what I called “statements of local determination.” I also argued that Libet-style experiments have not so far supported statements of that sort. In a commentary to the paper, Adina Roskies and Eddy Nahmias accept the claim about Libet-style experiments, but reject the claim about the possibilities of neuroscience. Ao analisar a teoria da memória mecânica de Hegel, a maioria dos intérpretes considerou apenas dois aspectos da memorização mecânica: o desaparecimento do significado nas palavras mecânicamente memorizadas ou a internalização totalmente abstrata da mente que as memoriza. No primeiro caso, a interpretação concentrou-se na relação entre o significante e o significado das palavras; no segundo caso, concentrou-se na relação entre o signo linguístico como um todo e a mente. Entretanto, a posição específica da memória mecânica na sistematização das atividades (...) cognitivas de Hegel não se baseia nessas duas relações, mas na relação entre o significado de cada palavra e o significado das outras palavras. Ao memorizar de cor fileiras de palavras que não estão conectadas umas às outras por seus significados, mas apenas pela força da mente que decide memorizá-las juntas, a mente se liberta de qualquer conteúdo dado externamente e sublima a referência linear do conteúdo representacional de cada significado à intuição em sua origem. A atualização do poder da mente de interconectar conteúdos de acordo com as próprias regras lógicas da mente realiza, para Hegel, a transição para o pensamento propriamente dito. (shrink)

Theoretical and practical activity have traditionally been understood as complementary activities: through theoretical activity the subject would internalize the external world, while through practical activity she would externalize her internal goals. Hegel scholars have often attempted to interpret the difference and relation between subjective and objective spirit on the basis of that way of understanding theoretical and practical activity. Such approach, however, raises serious exegetical and conceptual problems about the meaning and formal structure of Hegel´s entire philosophy of spirit. Indeed, (...) if what primarily characterizes subjective spirit is the activity of knowing considered as the process of idealization and internalization of the external world and what characterizes, in turn, objective spirit is the externalization of the goals of the will, how should we conceive within such explanatory framework the specificity of the acts of absolute spirit, that is to say, of the human behavior in art, religion, and philosophy? I will first attempt to clarify what exactly defines, according to Hegel, theoretical and practical activity, in order to develop on that basis an exegetical model that can satisfactorily account for Hegel´s peculiar periodization of the different forms of human activity. La exterioridad de una cosa o de un estado de cosas configurados por el ser humano no implica para Hegel que esa cosa o ese estado de cosas deban ya por ello ser considerados como formas del espíritu objetivo, mientras que en contrapartida las formas del espíritu absoluto estarían entonces conformadas por contenidos ideales del pensamiento. La diferencia entre espíritu objetivo y espíritu absoluto no radica en la diferencia entre lo que el espíritu humano “hace” y lo que “conoce”. En (...) efecto, las obras de arte, es decir, configuraciones exteriores hechas por el ser humano utilizando, por ejemplo, piedras, metales, colores o sonidos, son para Hegel instancias del espíritu absoluto, mientras que, por su parte, realidades que en cuanto tales no son intuibles, como, por ejemplo, los contratos o la organización estatal, son instancias del espíritu objetivo. Que Hegel considere al arte como una forma del espíritu absoluto pone de manifiesto que, a sus ojos, las cosas que intuimos en el universo son, en rigor, productos del propio sujeto que las conoce. Espontáneamente el sujeto cognoscente piensa que lo que intuye es algo que recibe desde un mundo externo; sostener que el arte es una forma de conocimiento es justamente el modo como Hegel está expresando que lo intuido es en todos los casos un contenido producido por el propio espíritu, que es, por así decirlo, una obra de arte humano. En el arte mismo, sin embargo, la producción de la cosa intuible es insuficiente, dado que el material que el espíritu utiliza para sus configuraciones conserva en mayor o menor medida, según el caso, una determinidad propia que resiste a la determinidad que el espíritu busca conferirle. Por esta razón, las obras de arte se presentan inicialmente como productos arbitrarios. Recién cuando integra sus intuiciones en la actividad de comprensión -actividad cognitiva con la que opera la filosofía- y media con ello completamente la determinidad de los contenidos intuidos, el espíritu configura finalmente un universo que le es propio y específico. El objetivo de mi ponencia es reconstruir desde el marco teórico recién expuesto el sentido y función que Hegel le atribuye al arte en su teoría del conocimiento. (shrink)

Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

Liberados el romanticismo y el idealismo del lastre secular de su vínculo imaginario con la “catástrofe alemana” deviene una vez más posible recurrir a ellos para repensar los problemas teóricos y prácticos del presente y localizar nuevos instrumentos conceptuales para su solución. En este contexto recobran interés numerosos temas que fueron objetos privilegiados de reflexión por parte de los pensadores románticos e idealistas. El romanticismo exaltó la Revolución Francesa como un acontecimiento epocal de reivindicación de los derechos de los individuos (...) contra la opresión de las formas anquilosadas de la religión y la organización estatal. Los pensadores románticos se rebelaron contra el orden burgués en todas sus formas, contra la pauta ubicua de la razón económico-instrumental. Para Kant, lo que es útil e intercambiable no posee dignidad, sino precio. El rechazo romántico de la exhaustiva reducción del mundo a mercancía conduce a la recuperación del valor infinito de la naturaleza, en esa medida, a su “reencantamiento”. En una misma línea, el romanticismo preconiza tendencialmente todos los fenómenos no cuantificables, aquéllos que no permiten ser calculados en términos mercantiles: la corporeidad, el erotismo, la pasión, la imaginación y la fantasía, el arte y la poesía, lo telúrico, la diversidad individual y cultural. El idealismo, por su parte, busca una síntesis entre la concepción ilustrada del mundo material y la visión pre-moderna del mismo. El resultado de esa mediación es la explicitación de las estructuras del propio espíritu humano presentes en su comprensión del mundo, toda vez que para el idealismo el mundo es siempre la teoría de la mente humana sobre el mundo. El pensamiento ilustrado pudo por ello confundir la filosofía de la naturaleza de los idealistas con una visión de lo material viciada de antropomorfismo, más próxima a la mística y a los bestiarios medievales que a las ciencias naturales de la Edad Moderna. El idealismo, por el contrario, encuentra en esta suerte de principio antrópico de toda teoría un factor de liberación moral y política. La toma de conciencia de que es el sujeto el que crea sistemas de sentido y que, por tanto, éstos deben reflejar en sí mismos su origen humano, implica el corolario de que con las teorías –sea cual sea el ámbito de la realidad que ellas busquen explicar– se trata en verdad de dispositivos de ordenamiento para el conocimiento y la acción construidas por la propia subjetividad humana; en esta medida, en su origen no se encuentran datos brutos de un supuesto orden natural que debe, por tanto, ser respetado sacralmente, sino la propia comunidad de sujetos vivientes. Aunque haya dejado tras de sí y olvidado el proceso de mediaciones que le dio origen, aunque se presente, pues, como replegado sobre sí mismo y, en esa medida, como la suma de re-presentaciones de un orden encontrado en el mundo, cada sistema de ideas contiene el conjunto de prácticas subjetivas inferenciales que lo constituyeron y que fueron realizadas por múltiples sujetos en plexos históricos concretos. El idealismo consiste en explicitar a la subjetividad actuando en el objeto y, con ello, en conminar el peligro de la mutación de las teorías en ideologías. El fundamento último de la libertad descansa para el idealismo menos en el orden determinado que funciona como condición de posibilidad del ejercicio de la libertad que en el modo de autoconcepción de la propia subjetividad. A partir del mundo de las autoconcepciones del sujeto –para Hegel se trata del ámbito específico del sujeto que ha devenido por ello mismo absoluto– derivan luego, como sus corolarios prácticos, las formas concretas de ordenamiento social y político. Si bien asume en sí numerosos motivos románticos, el idealismo aspira también a una mediación de esos elementos con las contribuciones teóricas de la Ilustración, con la que guarda entonces una relación menos crítica que el romanticismo. Fruto de este espíritu más ecuménico y menos orientado a la ruptura, defiende una concepción más pacífica de la racionalidad capitalista y el mundo burgués. Hegel reivindica así el rol positivo del mercado con su división social del trabajo y una concepción menos revolucionaria y más reformista de la vida política. El neoliberalismo contemporáneo se concibe a sí mismo como el sistema que resulta naturalmente del principio de la libertad negativa. Una tesis central del idealismo alemán es que para que sea posible el ejercicio de la capacidad de decidirse autónomamente por diferentes metas es necesario el marco efectivo de la libertad positiva. Sin la presencia de un orden racional con poder coercitivo sobre los miembros de la sociedad para regular su conducta, la libertad negativa de esos miembros, a primera vista disminuida y parcialmente cercenada por aquel orden, no es en la práctica posible. By treating America as a «new» continent «by virtue of its wholly peculiar character in both physical and political respects» Hegel reiterates the increasingly dominant image of America in the Europe of his time. This image crystallized in the context of the consolidation of the colonization process. According to Europeans, the inhabitants of the colonized lands were far less civilized than the inhabitants of Western Europe. Not a few thinkers found the explanation for that cultural difference in the natural differences (...) between the respective geographies, climates and races. In this general framework, Hegel considered the American Indians as people without history; as for the history of America after its conquest and colonization, it is in his eyes nothing other than an episode of the history of Europe itself. Insofar as it is through Europe´s history that human beings have attained self-consciousness of their essence, namely, freedom as autonomy and self-determination, Europe seems to be a non plus ultra of the ideological development of humanity. However, as seen from the perspective of the 21st century, the intellectual and political history of Europe can hardly be identified with the full awareness of the value and dignity of each human being as such. Since the countries of the American continent rely on the principle of civic nationalism and not on that of ethnic na-tionalism, which is typical for Europe, they signify, in this respect, a step forward with regard to the «principle of the European mind». Con excepción de Aristóteles, no hay quizá ningún otro filósofo al que Hegel se haya referido repetidamente en forma tan elogiosa como Descartes. Descartes es para Hegel quien por primera vez en la Historia de la Filosofía, antes que Fichte, advierte que la autoconciencia es un momento esencial de la objetividad del conocimiento humano y convierte así a la actividad como tal del pensar en principio fundamental de la filosofía. La introducción de este nuevo paradigma, a saber: el idealista, implica (...) una verdadera revolución teórica, cuyos corolarios los autores posteriores a Descartes intentan explicitar. En el contexto de este proceso de explicitación, Hegel - a primera vista, curiosamente - contrapone el pensamiento de Kant al de Descartes: si bien, por un lado, profundiza el modelo idealista, Kant, por el otro, hipostasia a ojos de Hegel el representacionalismo y, con ello, los elementos realistas presentes en el idealismo cartesiano. Para Hegel, la absolutización del principio idealista propuesto por Descartes significa, por el contrario, un retorno al espíritu genuino de su pensamiento. El idealismo absoluto se entiende, en efecto, como la consumación de un modelo teórico novedoso en filosofía. Ahora bien, no sólo el verdadero sentido de este modelo, sino ante todo su potencialidad explicativa en relación a los problemas fundamentales de la filosofía han pasado frecuentemente inadvertidos. Mediante el análisis de algunas tesis centrales en su proceso de constitución, en nuestra comunicación intentaremos arrojar luz sobre la naturaleza del paradigma del idealismo absoluto y, sobre esta base, examinaremos su relevancia para la problemática filosófica del presente en el ámbito de la teoría del conocimiento y la ontología. This paper is a response to replies by Dan López de Sa and Mark Jago to my ‘Truthmaking, Entailment, and the Conjuction Thesis’. In that paper, my main aim was to argue against the Entailment Principle by arguing against the Conjunction Thesis, which is entailed by the Entailment Principle. In the course of so doing, although not essential for my project in that paper, I defended the Disjunction Thesis. López de Sa has objected both to my defence of the Disjunction (...) Thesis and my case against the Conjunction Thesis. I shall show that his objections are unfounded and based on serious misunderstandings of my position, what the relevant debate is, and some fundamental notions of Truthmaker Theory. Jago argues that accepting the Disjunction Thesis and rejecting the Conjunction Thesis is hard to maintain. But I show that Jago has not shown that accepting the Disjunction Thesis while rejecting the Conjunction Thesis is impossible or even hard to maintain. Jago believes that, to accept the Disjunction Thesis while rejecting the Conjunction Thesis, one needs to reject his axiom (T3), which says that all the truthmakers for <P&P> are truthmakers for <P>. I argue that there are reasons to reject such a principle, and the version of it that says that what makes <P&P> true makes <P> true. (shrink)

The purpose of this paper is to describe how judges engage in constitutional design, irrespective of legal tradition. I examine in great detail the role of the judge: as a conflict solver, as a member of an institution, as part of the political system and as a human being, for those are factors that intervene in the activities he makes. I later analyze the dynamics that a Constitution can have: the change in their structure conceptualized as interpretation, mutation and resistance (...) and their relation. Interpretation is the determination of the scope of a norm, mutation is the change of meaning without amendment and resistance is a concept that bridges the first two, which is the capacity of the constitutional rule to adapt to the political game and to assume mutations. Finally, these concepts are intertwined in order to show how judges by means of their function, (re)design the Constitution by means of adjudication and policymaking (rule issuance by the stating of precedent). The logics of formal inconsistency (LFIs, for short) are paraconsistent logics (that is, logics containing contradictory but non-trivial theories) having a consistency connective which allows to recover the ex falso quodlibet principle in a controlled way. The aim of this paper is considering a novel semantical approach to first-order LFIs based on Tarskian structures defined over swap structures, a special class of multialgebras. The proposed semantical framework generalizes previous aproaches to quantified LFIs presented in the literature. The case of QmbC, (...) the simpler quantified LFI expanding classical logic, will be analyzed in detail. An axiomatic extension of QmbC called QLFI1o is also studied, which is equivalent to the quantified version of da Costa and D'Ottaviano 3-valued logic J3. The semantical structures for this logic turn out to be Tarkian structures based on twist structures. The expansion of QmbC and QLFI1o with a standard equality predicate is also considered. (shrink)

Con la tesis “el Absoluto es el ser”, Hegel quiere sentar el principio metafísico fundamental de la sustancialidad del Universo frente a las ontologías que lo conciben como una totalidad contingente. Para ello, sin embargo, la noción de “ser” (Sein) no debe ser absolutizada como tal, como puro ser, frente a la negación como tal o puro no-ser, es decir, frente a la nada. Ser y no-ser son para Hegel meras abstracciones del entendimiento humano. La primera verdadera y legítima noción (...) de ser es la de “existir” (Da-sein). El ser del ente entendido no más como ser frente a la nada absoluta, frente al no-ser del ser es decir, no más entendido como Sein, sino como ser frente al no-ser del ente (Daseiendes), frente a la no-existencia de éste es decir, entendido como Dasein, no remite a un fundamento diferente de sí, sino que descansa sustancialmente en sí mismo. The paper argues that grounding is neither irreflexive, nor asymmetric, nor transitive. In arguing for that conclusion the paper also arguesthat truthmaking is neither irreflexive, nor asymmetric, nor transitive.

In 1988, J. Ivlev proposed some (non-normal) modal systems which are semantically characterized by four-valued non-deterministic matrices in the sense of A. Avron and I. Lev. Swap structures are multialgebras (a.k.a. hyperalgebras) of a special kind, which were introduced in 2016 by W. Carnielli and M. Coniglio in order to give a non-deterministic semantical account for several paraconsistent logics known as logics of formal inconsistency, which are not algebraizable by means of the standard techniques. Each swap structure induces naturally a (...) non-deterministic matrix. The aim of this paper is to obtain a swap structures semantics for some Ivlev-like modal systems proposed in 2015 by M. Coniglio, L. Fariñas del Cerro and N. Peron. Completeness results will be stated by means of the notion of Lindenbaum–Tarski swap structures, which constitute a natural generalization to multialgebras of the concept of Lindenbaum–Tarski algebras.
